Finality of Sale
- The sale of Artwork under these Terms and Conditions is considered final and binding upon the Seller's receipt of full payment from the Buyer. The Buyer acknowledges that all sales are conclusive and that the Seller will not accept any returns of the Artwork once it has been delivered to the Buyer.
Non-Refundable Nature of Artwork
- The Buyer understands and agrees that due to the unique and often irreplaceable nature of the Artwork, all payments made to the Seller are non-refundable. The Buyer shall not be entitled to a refund of the purchase price under any circumstances.
No Exchange Policy
- The Seller does not offer an exchange option for any Artwork purchased. Each Artwork is sold as a unique piece and cannot be exchanged for other Artwork in the Seller's collection or inventory.
Buyer's Acceptance of Condition
- Prior to the sale, the Buyer is provided with a detailed description and, where applicable, images of the Artwork to ensure that the Buyer understands the condition of the Artwork being purchased. The Buyer acknowledges that they are satisfied with the Artwork's condition and that they have had the opportunity to inquire further with the Seller about the Artwork's condition prior to making the payment.
Limitation on Reference Use of Display Images
- The Buyer acknowledges that any scene images or display settings provided by the Seller, used for the exhibition of the Artwork, are for illustrative purposes only. These images may not accurately represent the actual size, dimensions, or specific details, such as size relative to surrounding objects, of the Artwork. Such representations are not to be relied upon as a reference for the Artwork’s suitability to the Buyer's intended display settings or for any other purpose. The Buyer agrees that the Seller shall not be held responsible for any discrepancy between the display scene images and the actual appearance of the Artwork in terms of scale, size, or how specific content parts or sections of the Artwork appear in situ.
Color Variance Due to Display Settings
- The Seller is not responsible for any color variances between the Artwork as viewed on the Buyer's display screen and the actual color of the Artwork upon delivery. Display screens can vary in their color representation due to a wide range of factors including, but not limited to, type, brand, settings, lighting conditions, and age of the device. The Buyer acknowledges that slight color differences perceived due to display settings are not considered a defect and do not constitute grounds for a return, refund, or exchange.
Exception for Incorrect Artwork
- The only exception to this policy is in the event that the Artwork delivered to the Buyer is not the Artwork that was purchased (i.e., a shipment error resulting in the Buyer receiving the wrong Artwork). In such a case, the Buyer must notify the Seller within 48 hours of receipt of the Artwork with evidence of the error. The Seller will then arrange for the return of the incorrect Artwork and delivery of the correct Artwork at the Seller's expense.
Buyer's Responsibility
- The Buyer is solely responsible for ensuring that the Artwork they have selected is to their satisfaction and is suitable for their purposes prior to making the purchase. The Seller is not responsible for the Buyer's change of mind or dissatisfaction with the Artwork's subjective aspects, such as stylistic preference or color.
Legal Effect
- This No Return, Refund, or Exchange Policy is part of the legal agreement between the Buyer and the Seller. By completing the purchase, the Buyer is confirming their understanding and acceptance of this policy as a binding term of the sale.
The Buyer's payment for the Artwork serves as their express acknowledgment and agreement that they are waiving any right to return the Artwork, receive a refund, or exchange the Artwork for any reason other than the aforementioned shipment error. This waiver is a material inducement to the Seller to complete the sale and would not have entered into the sale but for the Buyer's agreement to these terms.
